Terms of Service

Please read these terms carefully before using our platform.

1. Acceptance of Terms

Welcome to MKPAYZ, operated by MKPAYZ ("Company", "we", "us", or "our"). By accessing or using our website, mobile site, or any of our services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not use our Platform. These Terms apply to all visitors, users, and others who access or use the Platform.

These Terms constitute a legally binding agreement between you and MKPAYZ. Please read them carefully.

2. Our Services

MKPAYZ is a gift card reselling platform that allows users to purchase digital gift cards from a variety of brands. We act as a reseller and do not represent, own, or operate the underlying gift card brands or the platforms where the gift cards may be redeemed.

Our services include:

  • Online purchase of digital gift cards from supported brands
  • Delivery of gift card codes via email or in-app
  • Account management including balance top-ups and order history
  • Customer support for order-related issues

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

3. Eligibility

To use our Platform, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater)
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the services under applicable law
  • Provide accurate and truthful registration information

By using the Platform, you represent and warrant that you meet all of the foregoing eligibility requirements.

4. User Accounts

4.1 Registration

You must create an account to make purchases. You agree to provide accurate, current, and complete information and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, including if we suspect fraudulent activity, violation of these Terms, or abuse of our services.

4.4 Account Balance

Account balances are non-transferable and may not be exchanged for cash, except as required by applicable law or as explicitly approved by us.

5. Purchases & Payment

5.1 Pricing

All prices are displayed in the currency shown on the product listing. A service fee may be applied to each transaction, which will be clearly shown at checkout before payment is confirmed.

5.2 Payment Methods

We accept the following payment methods:

  • Stripe — Visa and Mastercard (processed securely by Stripe, Inc.)
  • Bank Transfer — Manual bank transfers (may require additional processing time)
  • Account Balance — Pre-loaded MKPAYZ balance

5.3 Authorization

By completing a purchase, you authorize us to charge the applicable amount to your chosen payment method. All transactions are final upon confirmation unless eligible for a refund under Section 7.

5.4 Failed Payments

If your payment fails or is declined, your order will not be processed. Please ensure your payment details are correct and try again or contact your bank.

⚠️ Never share your payment credentials with anyone. MKPAYZ staff will never ask for your card details, passwords, or OTP codes.

6. Delivery

Digital gift card codes are delivered to your registered email address and/or displayed in your dashboard. We aim to deliver all orders instantly upon payment confirmation.

Delivery times may vary due to:

  • High demand or system maintenance periods
  • Bank transfer payments requiring manual verification
  • Stock availability for the requested brand

If delivery has not occurred within 2 hours of a confirmed payment, please contact our support team. We are not responsible for delays caused by third-party email providers or spam filters.

7. Refund Policy

7.1 Eligibility

Refunds may be issued in the following circumstances:

  • A gift card code was not delivered within 24 hours of a confirmed payment
  • The delivered code is invalid, expired, or already used (verified by our support team)
  • A duplicate charge occurred due to a technical error

7.2 Non-Refundable Cases

Refunds will not be issued if:

  • The gift card code was successfully delivered and has already been used
  • You purchased the wrong brand, denomination, or region
  • The gift card was redeemed fraudulently (not by you) after we delivered it securely
  • More than 7 days have passed since the order date

7.3 How to Request a Refund

Submit a refund request through your dashboard under "My Orders" or contact us via the contact page. Include your Order ID and a description of the issue.

7.4 Processing Time

Approved refunds are credited to your MKPAYZ account balance within 24–48 hours. We do not issue refunds to the original payment method.

8. Prohibited Use

You agree not to use the Platform to:

  • Engage in any fraudulent, deceptive, or misleading activity
  • Purchase gift cards using stolen, fraudulent, or unauthorized payment methods
  • Resell, broker, or distribute gift cards obtained on our platform without our written permission
  • Create multiple accounts to abuse promotions, referral programs, or refund policies
  • Attempt to reverse-engineer, scrape, or copy any part of our Platform
  • Violate any applicable local, national, or international law or regulation
  • Use our platform for money laundering or any other financial crime

Violation of this section may result in immediate account suspension, legal action, and reporting to relevant authorities.

9. Intellectual Property

All content, trademarks, logos, and intellectual property on the Platform are the property of MKPAYZ or our licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

Gift card brand names, logos, and trademarks are the property of their respective owners. We are not affiliated with or endorsed by any gift card brand unless explicitly stated.

10. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, secure, or error-free
  • Any gift card code will remain valid indefinitely after delivery
  • Third-party brands will honor their gift cards as expected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MKPAYZ, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Our total liability to you for any claim arising from your use of the Platform shall not exceed the total amount paid by you to us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless MKPAYZ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with:

  • Your access to or use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any fraudulent or illegal activity on your account

13. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Platform will cease immediately. Any outstanding orders will be processed or refunded at our discretion. Account balances may be subject to review before being returned.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malawi, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration or in the courts of Malawi, as applicable.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
